Man Held in Solitary Confinement 2 Years After DWI Gets $22M

A man who spent two years in solitary confinement after getting arrested for DWI was awarded $22 million for suffering inhumane treatment in New Mexico's Dona Ana County Jail.
Stephen Slevin was arrested in August of 2005 for driving while intoxicated, according to NBC station KOB.com. He said he never got a trial and spent the entire time languishing in solitary, even pulling his own tooth when he was denied dental care. "'[Prison officials were] walking by me every day, watching me deteriorate," he said. "Day after day after day, they did nothing, nothing at all, to get me any help."

Good bye Fifth Amendment

Say good bye to the Fifth Amendment’s protection against compelled self-incrimination.

"A judge on Monday ordered a Colorado woman to decrypt her laptop computer so prosecutors can use the files against her in a criminal case. The defendant, accused of bank fraud, had unsuccessfully argued that being forced to do so violates the Fifth Amendment’s protection against compelled self-incrimination. “I conclude that the Fifth Amendment is not implicated by requiring production of the unencrypted contents of the Toshiba Satellite M305 laptop computer,” Colorado U.S. District Judge Robert Blackburn ruled Monday. The authorities seized the laptop from defendant Ramona Fricosu in 2010 with a court warrant while investigating financial fraud. The case is being closely watched (.pdf) by civil rights groups, as the issue has never been squarely weighed in on by the Supreme Court."

Two women in their 20s, one from Sunrise and another from Fort Lauderdale, were involved in a single-car collision with a tree near that intersection about 4:30 a.m., according to Plantation police.

Police said a second driver stopped to check on their well-being. All three people, standing outside their vehicles, were then struck by a car driven by a Plantation man, according to Detective Phillip Toman.

One of the women was pronounced dead at the scene, according to Plantation Fire Department Battalion Chief Joel Gordon.  The second woman and the man who stopped were taken to Broward General Medical Center, where they died, according to Toman.

Seattle sues attorney over public records request

SEATTLE -- On the heels of a scathing federal review of Seattle police practices, dash-cam video is once again at the center of a firestorm at City Hall. This time, the city is suing an attorney who wanted dash-cam videos connected to alleged police misconduct. KOMO News sued the city of Seattle after public information requests for police dash-cam video were not fulfilled. The suit alleges violation of the public records law. (click here for original article But criminal defense attorney James Egan never expected the city would preemptively sue him just for asking for police dash cam video. "Shocked. I am shocked," he said. "What the police department is saying is if you make a request for public documents, ultimately you will be sued." The situation involves two cases Egan handled pro bono. He believed the videos in each case show officer misconduct. Egan wanted to know if those officers had other questionable arrests, so he asked for 36 additional dash-cam videos. But the city refused, citing privacy laws. Egan appealed, and now the city is suing him. "This is ridiculous. It would be comical if it weren't alarming," he said. Egan believes the city is retaliating for making these other videos public. "I kind of expect for something like this that they really do have something to hide," said Egan. But Seattle City Attorney Pete Holmes, who filed the lawsuit, says the city is caught between two conflicting laws. "There's a plain conflict in the laws between the Public Records Act (and) the Privacy Act. The city will pay dearly if it makes the wrong choice," said Holmes. When asked whether an attempt was made to cover up the 36 requested videos, Holmes said, "None whatsoever." The dash-cam videos can be critical in ferreting out officer misconduct. The U.S. Department of Justice reviewed hundreds of these clips in determining that the Seattle Police Department had problems with excessive force. Holmes says before police start releasing dash-cam videos, they need a judge's guidance on the conflict between privacy laws and public disclosure laws. "We're going to work with the DOJ on these broader issues regarding SPD," said Holmes, adding improvements will not be made "if we start deciding which laws we're going to enforce and which ones we're not." The city argues it doesn't have to release any videos for three years. That also happens to be when the statute of limitations runs out for suing the city and, as a KOMO News investigation discovered, it is also when dash-cam videos are routinely erased from the system. CHICAGO -- A suburban Chicago police officer used a $132 speeding ticket he issued to track down a woman and ask her for a date, saying the least he could do for costing her so much money was to buy her dinner, a lawsuit filed by the woman alleges.

Evangelina Paredes accuses Stickney cop Chris Collins of violating her privacy by searching motor-vehicle records for her address, then leaving a handwritten note on her car windshield outside her apartment two days after she was ticketed.

A copy of the alleged note was attached to the lawsuit, filed last week in U.S. District Court in Chicago. It starts with an attempt at self-deprecating humor, saying, "It's Chris ... that ugly bald Stickney cop who gave you that ticket."

Upmarket French fashion chain La Redoute landed itself in hot water today (4 January) after inadvertently publishing a photo of a naked man on its website.

To make matters worse, the shoot featured four children - all dressed in La Redoute swimwear and happily playing on an idyllic-looking beach - with the nude individual just visible in the water behind them. Whoever edited the photo and published it on the site was apparently unaware of the X-rated mishap, but reaction was swift on Twitter, with the French expressing both amusement and outrage.
